L'Audiència Provincial Durant la Guerra Civil, els rebels van aprovar una legislació sense garanties processals per reprimir les institucions republicanes i la democràcia, que es va aplicar immediatament als territoris ocupats. Es basava en el grau de declaració de l'estat de guerra (1936) i es complementava amb la Llei de responsabilitats polítiques (1939) i la Llei de repressió de la maçoneria i el comunisme (1941). La pena de mort es va reincorporar al codi penal i es van disparar nombrosos presos condemnats. Tarragona va ser ocupada per les tropes franquistes el 15 de gener de 1939.
