L'Audiència Provincial Durant la Guerra Civil, els rebels van aprovar una legislació sense garanties processals per reprimir les institucions republicanes i la democràcia, que es va aplicar immediatament als territoris ocupats. Es basava en el grau de declaració de l'estat de guerra (1936) i es complementava amb la Llei de responsabilitats polítiques (1939) i la Llei de repressió de la maçoneria i el comunisme (1941). La pena de mort es va reincorporar al codi penal i es van disparar nombrosos presos condemnats. Tarragona va ser ocupada per les tropes franquistes el 15 de gener de 1939. Un títol de l'1 de novembre de 1936 va ordenar la constitució de jutjats marcials permanents a les ciutats ocupades. Es pronunciaran en un procediment conegut com a judici sumari urgent. Després de la guerra civil, el 1941 es va constituir a Tarragona un jutjat de guerra. Va sorgir al Tribunal de Guerra de la 4a Regió Militar amb seu a Barcelona. L’estat de guerra no es va aixecar fins a 1948. En aquest edifici, actualment seu de l’Audiència Provincial de Tarragona, es van celebrar els jutjats marcials públics. La pena de muerte se reincorporó al código penal y numerosos presos condenados fueron fusilados. Tarragona fue ocupada por las tropas franquistas el 15 de enero de 1939.
